Fair Hiring in Banking Summary

This summary outlines the FDIC’s final rule implementing the Fair Hiring in Banking Act. The rule redefines who needs FDIC consent to work in or with an FDIC-insured institution; when consent is unnecessary; and how consent applications are filed, evaluated, and appealed. Certain older offenses, expunged or sealed matters, and de minimis offenses are exempt from coverage. The rule modernizes procedures, allowing applications to be filed by individuals, insured depository institutions, or depository holding companies. The rule was effective October 1, 2024.
