Summary of Home Buyers Privacy Protection Act

The Homebuyers Privacy Protection Act is set to go into effect on March 4, 2025. The Act seeks to restrict trigger leads by adding a new limitation inside the Fair Credit Reporting Act (FCRA), section 604(c), that restricts when a consumer reporting agency may furnish a consumer report to another person after a consumer report is requested by a person in connection with a residential mortgage loan. The restriction applies unless the furnishing supports a firm offer of credit or insurance and either the consumer affirmatively authorizes the furnishing or the recipient qualifies under narrow relationship-based categories.
