False Advertising, Misrepresentation of Insured Status, and Misuse of the FDIC’s Name or Logo Proposed Rule Summary

This tool summarizes the FDIC’s Proposed Rule creating § 328, which implements § 18(4) of the Federal Deposit Insurance Act. The proposed rule describes the process by which the FDIC will identify and investigate conduct that may violate section 18(a)(4) of the Act; the standards under which the FDIC will evaluate such conduct; and the procedures which the FDIC will follow when formally and informally enforcing the provisions of section 18(a)(4) of the Act. The FDIC seeks comment on all aspects of the proposed rulemaking and offers 11 specific questions for comment.
