Rights of Servicemembers and their Dependents to Terminate Premises and Motor Vehicle Leases Under the Servicemembers Civil Relief Act

This tool summarizes, P. Law 116-158, S. 3637, the amendment to Section 3955 of the Servicemembers Civil Relief Act. The following are the key takeaways of the changes:

  1. Servicemembers or their dependents must present each of the following orders to terminate a lease under the provisions of the Act: (1) original military orders; and (2) subsequent stop movement orders issued by the Secretary of Defense of the United States.
  2. Qualifying leases under the Act may now be terminated without requiring servicemembers to change a duty of station.
  3. The amendment provides different requirements for premises and motor vehicle leases to be eligible for termination under stop movement orders.
