Summary of Interpretive Rules, Policy Statements, and Advisory Opinions; Withdrawal

The following is a summary of each item of rescinded guidance, broken down in two ways; first, by its “guidance category” (i.e. Policy Statements, Interpretive Rules, Advisory Opinions, and Other Guidance), and within each respective “guidance category,” by their associated regulation and / or subject matter (e.g. Regulation B / Equal Credit Opportunity Act, Unfair Deceptive, or Abusive Acts or Practices, Federal Credit Reporting Act, etc.). Following the summary of each of the “Interpretive Rules, Policy Statements, and Advisory Opinions; Withdrawal” items, there is a summary of 4 other rescinded rules that were withdrawn shortly after, from May 15th to 16th.
Specifically, also includes a summary of:
- “Electronic Fund Transfers Through Accounts Established Primarily for Personal, Family, or Household Purposes Using Emerging Payment Mechanisms”; “Withdrawal (90 FR 20568 (May 15, 2025));
- Prohibited Terms and Conditions in Agreements for Consumer Financial Products or Services (Regulation AA); Withdrawal of Proposed Rule” (90 FR 20569 (May 15, 2025));
- “Protecting Americans From Harmful Data Broker Practices (Regulation V); Withdrawal of Proposed Rule” (90 FR 20568 (May 15, 2025)); and
- “Protections for Borrowers Affected by the COVID-19 Emergency Under the Real Estate Settlement Procedures Act (RESPA), Regulation X; Rescission” (90 FR 20791 (May 16, 2025))
