Notice of Proposed Rulemaking for Large-Bank Deposit Insurance Determination Modernization

October 30, 2026 / Source: FDIC

Summary:

The Federal Deposit Insurance Corporation (FDIC) Board of Directors today approved a notice of proposed rulemaking that seeks comment on a proposal to rescind the FDIC’s Part 370 recordkeeping rule and to revise the Large-Bank Deposit Insurance Determination Modernization rule codified at 12 CFR § 360.9.

Statement of Applicability: IDIs with two million or more deposit accounts; and IDIs that have at least $2 billion in deposits and at least either: 250,000 deposit accounts or $20 billion in total assets, regardless of the number of deposit accounts.

Highlights:

The proposal would:

  • Rescind the Recordkeeping for Timely Deposit Insurance Determination rule, 12 CFR part 370 (part 370). Due to advancements in the FDIC’s capabilities and systems to make deposit insurance determinations, FDIC will no longer require IDIs with two million or more deposit accounts to build and maintain IT systems capable of calculating deposit insurance coverage.
  • Revise the Large-Bank Deposit Insurance Determination Modernization rule, 12 CFR § 360.9 (section 360.9), to add and revise certain definitions and include certain additional requirements that would only apply to larger covered institutions (which would generally include institutions that are currently subject to part 370).
  • Impose no new requirements or additional burdens on covered institutions currently subject to section 360.9.

Comments on the proposal are due 60 days after the date of publication in the Federal Register.
