Summary of Children’s Online Privacy Protection Rule

The United States Federal Trade Commission (the “FTC”) amended the Children’s Online Privacy Protection Rule (“COPPA” or “the Rule”) to ensure that it aligns with the Children’s Online Privacy Protection Act. The changes were made to update the rule to answer public comments, update the rule after enforcement actions, and update the rule to modern technology. Key takeaways from the amendment include:

1. Creating a new definition for a “mixed audience website”
2. Amending definitions, including “personal information,” “online contact information,” and “support for the internal operations of a website or online service”
3. Updating operators’ responsibilities to issue direct and online notices; information security, deletion, and retention protocols; and FTC-approved COPPA Safe Harbor programs’ annual assessment, disclosure, and reporting requirements.
4. Adopting amendments relating to parental consent including consent requirements, obtaining consent, and exceptions to consent.
