Compliance Date: OSHA Emergency Temporary Standard

On November 5, 2021, the Occupational Safety and Health Administration (OSHA) published in the Federal Register an emergency temporary standard (ETS) that establishes binding requirements for employers of 100 employees or more “to protect unvaccinated employees . . . from the risk of contracting COVID-19 in the workplace.” The ETS became effective immediately. Employers must request proof of vaccination status beginning December 6 (30 days from publication). Testing for employees who are not fully vaccinated must begin by January 4, 2022. Note that on 11/06/2021, a federal appellate court issued an administrative stay of enforcement of the emergency temporary standard. As a result, the ETS may become subject to a permanent injunction, but the ultimate resolution is yet to be determined as of the date of this publication (11/08/2021).
