This webinar focuses on the Fair Debt Collection Practices Act (FDCPA) and how it impacts banks, particularly in light of the CFPB’s UDAAP guidance. While the FDCPA does not directly apply to first party debt collectors (i.e. many banks), the CFPB has indicated that violations of the provisions enumerated in the FDCPA may amount to a UDAAP violation. The webinar begins with a broad overview of the FDCPA, its background, scope and purpose. We will then dive into the specific prohibitions and limitations on collecting debt. Finally, real world examples will be provided to show common violations and highlight ways to avoid them. The webinar has been approved for 1.25 CRCM credits.
