Effective Date: Unsafe or Unsound Practices, Matters Requiring Attention

AGENCY:

Office of the Comptroller of the Currency, Treasury, and the Federal Deposit Insurance Corporation.

ACTION:

Final rule.

SUMMARY:

The FDIC and OCC have finalized a rule that narrows, clarifies, and standardizes what counts as an “unsafe or unsound practice” and when examiners may issue an MRA. The intent is to focus supervision on material financial risks, reduce examiner discretion on non‑financial issues, and improve consistency across institutions. This rule does not change laws, but it changes how examiners may apply them

DATES:

The final rule is effective November 2, 2026.
