Effective Date: Enhancing the Ability of Consumers To Control the Robocalls

AGENCY:

Federal Communications Commission.

ACTION:

Final rule.

SUMMARY:

The FCC issued this Order and NPRM seeking to update the TCPA robocall consent rules to give consumers clearer ways to revoke consent, while preserving their ability to receive desired informational communications, such as fraud alerts and account notifications. Most notably for financial institutions, the NPRM suggests that the FCC would allow callers to interpret an opt-out request as applying only to the specific category of informational calls or texts involved, rather than automatically stopping all communications, provided consumers retain a method to revoke consent more broadly. The NPRM also permits callers to designate an exclusive revocation method and expands the financial institution exemption to make it easier to deliver fraud-related alerts to customers. In addition, the FCC is seeking comment on further changes involving opt-out processing timeframes, two-way texting requirements, “revoke all” options, and affiliate communications, all of which could affect how banks manage customer contact preferences, TCPA compliance, and fraud-prevention messaging.
