SUMMARY:

The proposed rule would give state chartered banks the same treatment as national banks when providing services outside their home state, ensuring that host state laws apply or don’t apply uniformly regardless of whether a state bank operates through a branch or digitally. The rule is meant to resolve legal uncertainty highlighted by Illinois’ Interchange Fee Prohibition Act, prevent competitive disadvantages for state banks, and avoid disruptions in payment card processing. The intent is to preserve parity, reduces compliance risk, and supports consistent interstate operations.
