Comment Period: Violations of Laws or Regulations

Notice of proposed rulemaking.

SUMMARY:

The OCC has issued a NPRM that would significantly refine how examiners classify and respond to violations of laws and regulations, with direct implications for how banks experience supervision. The proposal introduces a clearer framework that distinguishes between substantive violations, such as those that could meaningfully impact the bank or its customers, and technical violations, which are less consequential and will be handled through less harsh supervisory methods rather than MRAs. Only substantive violations such as those with real potential to affect safety, soundness, compliance, or customer would qualify. As such, this reduces the likelihood of MRAs for minor, technical, or isolated issues and aligns supervisory focus with risk and impact.
