Comment Period: Rule on Impersonation of Government and Businesses

AGENCY:

Federal Trade Commission.

ACTION:

Advance notice of proposed rulemaking (“ANPRM”); request for public comment.

SUMMARY:

The FTC’s ANPRM seeks comments on expanding protections against government and business impersonation scams, particularly those facilitated through search engines, social media platforms, and other digital marketplaces. The FTC notes that impersonation scams remain one of the most common fraud types affecting consumers, with reported losses reaching billions of dollars annually. The agency is evaluating whether online platforms that optimize and distribute advertisements should bear greater responsibility when their services help fraudsters impersonate legitimate businesses, government agencies, or trusted organizations. For banks, the proposal highlights the ongoing regulatory focus on fraud prevention, consumer protection, and the misuse of trusted business identities, including banks, in scams involving payments, account access, transfers, toll collections, and other financial transactions

DATES:

Comments must be received on or before November 30, 2026.
